What is this?

We at Main Event love seeing people sharing their experiences at Main Event. Sometimes, Main Event will reach out to our customers to seek their permission to feature their content on our various social media channels, websites, and/or other promotional platforms including printed materials. You have been directed to this page because Main Event would love to showcase your content in this way!

If you choose to allow us to use your content (“Your Content”) by replying as instructed by Main Event, you are agreeing to the Terms of Use described below. Main Event reserves the right to alter these Terms of Use without advance notice by posting a revised Terms of Use.

For purposes of these Terms of Use, “Main Event” means Main Event Entertainment, L.P. and its related companies, affiliates, agents, licensees, sublicensees, contractors, successors, legal representatives, assigns, and third-party service providers, and their respective retail partners, marketing or public relations agencies, and other affiliates (collectively, “Main Event”).

This is a legal contract.

By granting Main Event permission to use Your Content and in consideration of the mutual covenants, terms and conditions set forth herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, you and Main Event (the “Parties”) agree:

·       You, at all times, retain ownership of Your Content.

·       You agree that:

a)     is your original creation;

b)     does not infringe on the copyright or other rights of any third party;

c)     does not contain any content or material that is libelous, defamatory, obscene, abusive, harassing, or otherwise offensive or illegal;

d)     does not contain or reference any non- Main Event brands or trademarks; and

e)     to the extent it contains any individual person other than You, you have the permission of all people appearing in Your Content to allow Main Event to feature their likeness/image on our various social media channels, websites, and/or other promotional materials.

·       You grant Main Event a worldwide, perpetual, royalty-free, fully-paid, non-exclusive, transferable, sublicensable right and license to use Your Content in any manner to be determined in Main Event’s sole discretion, including but not limited to making derivative works and use on Main Event’s social media pages and websites, and in any and all other marketing, promotional, or advertising initiatives, and in any format or medium now known or later developed. Main Event may use, display, reproduce, distribute, store, publish, reformat, broadcast, transmit, create derivative works from, combine with other materials, edit, or transform Your Content in any manner in Main Event’s sole discretion. You hereby irrevocably waive any claims based on “moral rights” and similar theories, if any.

·       You acknowledged that Main Event may, through the use of Your Content, disclose your handle, username, real name, image, likeness, location or other identifying information, including but not limited to your voice. You hereby irrevocably waive any claims based on right of publicity or privacy. 

·       You acknowledge that Main Event is under no obligation to use Your Content and reserves the right to discontinue use of Your Content at any time. Likewise, You may request at any time that that Main Event cease using Your Content, and Main Event will take all commercially reasonable steps to discontinue use of Your Content in new advertising initiatives, but shall have no obligation to remove any of Your Content that has already been used.

·       You acknowledge that you do not acquire any ownership or other rights in Main Event’s brands, social media, websites, or any other promotional materials through the permissions you grant to Main Event to use Your Content.  The royalty-free nature of our license to Your Content means that we do not owe you any compensation or fees in connection with our use of Your Content or in connection with any revenue or business advantage that we might enjoy as a result of such use.

·       You acknowledge that these Terms of Use are personal to you. They may not be assigned or transferred by you without Main Event’s prior written consent; and any action or conduct in violation of the foregoing shall be void and without effect.

·       You acknowledge that Your Content is deemed non-confidential and Main Event has no obligation to maintain the confidentiality of any information, in whatever form, contained in any submission, except pursuant to Main Event’s privacy policies, https://www.mainevent.com/privacy-policy You hereby release, discharge and agree to hold Main Event, and any person acting on our behalf, harmless from any liability related in any way to Main Event’s use of Your Content. 

·       You agree that any and all disputes that you may have with, or claims you may have relating to, arising out of or connected in any way with Main Event’s use of Your Content or these Terms of Use shall be governed by the laws of the State of Texas. ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS TERMS OF USE, OR THE BREACH THEREOF, SHALL BE SETTLED BY ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS COMMERCIAL ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR(S) MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. THE ARBITRAL TRIBUNAL MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Use are invalid, then that provision will be removed without affecting the rest of the Terms of Use. The remaining provisions of these Terms of Use will continue to be valid and enforceable.

·       You agree that this contract constitutes the entire agreement of the Parties and supersedes any prior agreements or understandings between them, whether oral or written, and may not be modified, altered or amended in any respect except in writing signed by both Parties. 

You agree that Main Event has reasonably relied on the above representations and that you shall be responsible for and indemnify Main Event against any claims and liabilities that may result from the inaccuracy of these representations or from the content of Your Content.
